These Terms of Service ("Terms") govern your use of Da Birthday Club ("we", "us", "our") and the membership, savings and card services we offer. By joining the waitlist, backing the launch, or using the service once available, you agree to these Terms.
Da Birthday Club is a savings membership. You choose how much to save and how often — weekly, fortnightly or monthly — and the app helps you set an amount you can comfortably afford based on your income. That amount is automatically deducted from your own bank account each cycle and held on your behalf in a safeguarded account with a licensed payments partner. On your birthday the balance is issued to you in full as a digital Visa card you can spend anywhere Visa is accepted.
You must be at least 18 years old and a New Zealand resident to become a member. We may ask you to verify your identity before activating your account, in line with applicable New Zealand law.
The money you choose to save is your own. It is deducted from your own bank account at the amount and frequency you set, and is held separately from our own operating funds in a safeguarded account with our licensed payments partner. We do not lend out, invest, or otherwise use your savings for our own purposes. Your birthday payout equals your full accumulated savings balance, returned to you in full — the monthly membership fee is charged separately and is not deducted from your savings.
By becoming a member you agree that the money you save is set aside until your birthday and is not available for early withdrawal. This lock-in is a core feature of the membership — it is what removes the temptation to dip in and is what distinguishes the club from an everyday transaction account. We will make this lock-in clear and prominent before you sign up.
Genuine hardship. If you experience genuine, unforeseen financial hardship, you may apply for an early release of your savings, and we will assess your request fairly and reasonably. We will not unreasonably withhold release in cases of genuine hardship.
The monthly membership fee, and any other fees, are shown clearly before you sign up and in your account. The membership fee is separate from, and never deducted from, your savings. You may cancel your membership at any time. On cancellation, your saved balance is returned to you; any cancellation fee is limited to a fair, pre-disclosed amount that reflects our reasonable costs.
Your birthday payout is delivered as a digital Visa card issued by our licensed card-issuing partner. Use of the card is also subject to the card issuer's cardholder terms, which we will provide. The card is valid for the period stated at issue.
You may cancel your membership at any time from within the app. On cancellation your held savings balance is returned to you; any applicable cancellation fee is fair, pre-disclosed, and described in your account.
If something goes wrong, we want to put it right. Please contact us first at [email protected] and we will work with you in good faith to resolve it promptly and fairly. If we cannot resolve a complaint to your satisfaction, you retain your rights under New Zealand consumer law — including, where applicable, raising the matter with the Commerce Commission (Fair Trading Act) or the Disputes Tribunal. Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
If you experience genuine, unforeseen financial hardship, you may apply for an early release of your savings using our Hardship Withdrawal process. We will assess your request fairly and will not unreasonably withhold release in cases of genuine hardship.
We may update these Terms from time to time. If we make material changes, we will notify you. Continued use of the service after changes take effect means you accept the updated Terms.
